Wisconsin Oligarchs: What They Bought - What They Paid

Oligarchs Taste Victory but Discover the Cost

Of course, MeanMesa was disappointed with the results of the Wisconsin recall election, but -- given the enduring, cheery outlook of this little blog -- the next step must be to look for a ray of hope amid the dismal reality.  Yes, Governor Walker's penchant for inspiring further class division seems to be on track for the moment, and, yes, the only slightly less rich oligarchs standing in the "out of state" shadows are smiling broadly, but is there a "silver lining" lurking just below the obvious here?

A "New Owner" of Wisconsin. (image source)

That would be, "is everything as dark as it looks?" or "is there a silver lining" lurking just below the final vote count in the recall election?

When considered in the first blush, the Citizens United advance seems to be unstoppable.  The prospect of the oligarchic ambition of finally decimating the last bones of the Republic during its final descent seems to be an unavoidable horror.  No matter what resistance is raised among those still cognizant of the democracy, the massive wealth and unbridled avarice of the conquerors may not only seem destined to inevitably carry this day -- but every day to follow.

Worse, these early defeats will not be mere startling exceptions in this grisly forecast.  Outrages such as the Wisconsin recall will be seen as little more than "testing the spears" when set next to what will almost certainly follow.

This post has two primary points to make.

First,
"Are the oligarchs prepared to continue to pay this much?"

Not long after the onset of the Civil War the incredibly awful price of the social division which had precipitated it began to become clear.  By the end of the Civil War the horror had become unavoidably manifest.  By then, the blood, pain and death had visited every home in both the North and the South.

However, as we "look for the light," we must consider the price the wealth class has paid for the Wisconsin victory.

Current estimates are that Governor Walker's oligarch cash amounted to between $25 and $30 Mn.  Some estimates ranged as high as $60 Mn.  Right here, we must also note that the brave pro-democracy forces were able to raise around $4 to $6 Mn.  [MeanMesa sent a few bucks to opposition candidate Barret.]

Of course, the oligarch owned media dutifully reported the money side of the contest with "news" conveniently absent any specifics, always implying that,  money-wise, both sides were financed with roughly equal resources.  Also glaringly absent from the "news" stories was any estimate -- or even mention -- of the "ROI" ["return on investment"] the oligarch class was anticipating in return from their cash commitment to the Walker.

But, well, let's look at the numbers.

Slipping painlessly past any difficulties with the presumption that "cash delivers votes," we can consider the admittedly over simplified ratios emerging in such a subjective conclusion.  Further, because the oligarchs, thanks to their wonderfully awful "quality of being," are ruthlessly pragmatic.  In this case, we can assume that this "oligarchic pragmatism" will have no difficulty whatsoever in "bottom-lining" their, uh, campaign contributions.

Because, inebriated in their glee over their new ownership of the State of Wisconsin, they have "slipped the surly bonds" of logical mathematics, they will attribute their "victorious new ownership" in terms of the amount of their "contributions" cast roughshod into an adolescent ratio with the "margin of error" in the vote, or, as they see it, the size of their victory.

$35 Mn = 1.33 Mn votes for the Governor.
$5 Mn = 1.11 Mn votes for the recall

Careening even more recklessly into this overly simplified mode of considering the outcomes, we can do a fast "fly by" of equation subtraction and reach two  "equally unfounded" arguments -- one with respect to what was required to win the election and one which considers what was actually "paid" to sway each strategic element in deciding the contest, that is, for each vote in the election's now famous, "liberty" and "free market" margin.

Each oligarch, sitting impatiently with his gold plated abacus in hand, will calculate the cost of his astonishing good fortune something like this.

1.  $30 Mn delivered the .22 Mn votes in the final differential
so,
2.  $30,000,000/220,000 votes = around $14 per vote

Of course, the billionaires who recently purchased Wisconsin can afford such an expenditure quite comfortably given their expectation of a now, more than ever, exceptionally delirious looting festival once they take possession.  Although $30 Mn may seem to be quite the "pile" to the likes of MeanMesa visitors, the picture's spectacular quality dims considerably when the true scope of things is considered.

Gee, which state shall we buy next?
Perhaps, I should think of what might be attractive on my charm bracelet.

If you are a billionaire, this means that you have wealth amounting to 1,000 million dollars.  The full purchase price of Wisconsin would amount to only 30 of the 1,000 millions that you have.

However, we now must look even further "down the field"  if we are still interested in what the horizon may look like to our Wisconsin plutocrat.  In 2008 130 Mn votes were cast in the Presidential election, about 70 Mn for Obama and about 60 Mn for John McCain.

Slipping back into our "mathematically pragmatic" calculations, this would leave the margin about around 10 million votes.  If you are an oligarch with the ambition of finally subduing all remaining resistance in the old democracy, this means that you would need to "finance" the shift of a few more than 5 million votes to win the 2012 Presidential election.

130,000,000 voters in a Presidential election/2 candidates
 = 65,000,000 each
$1 Bn on each side directed to winning 65,000,000 votes.
A "winning increment" -- purchased at $14 per vote -- breaks
the 65,000,000/65,000,000 deadlock, delivering the Presidency.

The 2008 Obama election victory was around 10,000,000 [10 Mn] votes.  If Citizens United cash can "secure" 1/2 of Obama's victory margin, 5 Mn votes, the race becomes a "cash toss up."

So much for democracy.

If the "price per vote" rate in Wisconsin has any merit, this move would require about $14 per vote switched, a paltry $70 Mn.  The amount currently budgeted for this task by the oligarch party is $1 Bn.  This is, theoretically, enough to not just "sway" the 5 million votes you will need to subdue the election, but enough, in fact, to blanket the election very, very richly.

Of course we must remember that the oligarchs will need to over top the Obama spending by this amount.  He plans to have a $1 Bn war chest also.  Still, given the cash which has already "flown into the coop" during the Republican Primary, this is chump change.  If they find themselves positioned to drop a closely targeted $70 or $100 Mn dollars at exactly the right time and place during the general election, they can win.

Second, "Why was it possible?"

The clear mechanism through which the cash was transformed into an election advantage in Wisconsin was the possibility it introduced with media purchases to credibly protect the populist falsehoods presented by the Governor.  He found himself in the awkward position of absolutely needing to misrepresent the common facts of his record while relying on his Citizens United financed media saturation to protect him from the any effective challenge or contradiction.

However, how in the world would something like this ever become a campaign advantage?  Wasn't the Governor ever nervous about his felonius campaign lines being seen through by voters?

Amazingly, the Governor didn't need to be nervous at all.  Perhaps even more interesting, although the media saturation made possible by the Citizens United cash certainly helped, the Governor would have, most likely, not suffered any significant "fact rash" reaction from the 1.33 Mn Wisconsonites who ultimately protected his looting scheme from the recall.

This second part of the post deals precisely with this.

To assist MeanMesa visitors in making the fundamental principle in play right here entirely comfortable, let's meander through a few highly presumptive, electoral "something or other" propositions which have, quite grotesquely, become "mistaken certainties."

The premise:  The more money a candidate has to spend, the more likely it is that he will win an election.

The "something or other" propositions:

1. The more money a candidate has, the better elected officer he will become.

2. If a candidate were not really the best choice all along, his campaign wouldn't have such an immense war chest.

3. If a candidate doesn't have an immense war chest, he is probably a loser.

4. Rich people are rich because they are smart.  Rich people are richer than me because they are smarter than me.  The smart money will always find the best candidate, so I'm going with their choice.

5. If a candidate has a huge war chest, he SHOULD be elected.

These could drabble long until the list reached electoral infinity.  However, boiled down to the bones, the general idea is that the more money a candidate can spend, the more people will vote for him.  He becomes more familiar to them the more they see him and hear him.  When he becomes more familiar, he becomes more trustworthy.  When he says the same -- unexamined -- things more and more frequently, when he becomes trustworthy and when when he becomes credible because he always says the same things, he deserves to be elected.

He becomes a "safe" electoral choice.

America's raging, cultural codependency takes it from there.

This explains exactly what is happening to us and to our democracy.  Voters have thoroughly adopted the idea that the predictably hard work of actually examining a candidate's campaign rhetoric amounts to an unfair responsibility.  This hearty indulgence extends beyond election day.  Once the election is over, voters firmly believe that their job is done.

Everything said and done during the campaign is forgotten.

If this were not to be the case with Governor Walker, the remainder of his tenure in office would be nightmarish.  It won't be.

Please spend a few extra minutes with this MeanMesa article and take a look at this previous posting.

Oh sure, there were a few "rough edges" for the state because of the recall effort, but the "ruffled feathers" should calm down quickly enough, right?

No.  The State of Wisconsin has been shredded, and it will remain shredded for a long time. The Governor carefully crafted a campaign which directly addressed the lowest elements of his base.  It was composed of fear of basically the same shade as the fear of a caveman.  It exploited the jealousy of those who drew pay checks absent the wages and benefits of those who enjoyed the outcome of collective bargaining.

The Governor's campaign, no doubt well serviced by hate mongers such as Karl Rove and others, divided the State to the maximum possible level, and it was in this brutally divided State where the Governor found the votes he needed.  Of course what remained of Wisconsin after election day was a wreckage of social division and paranoia -- on both sides of the "fight."  What Wisconsin will realize now is that it was manipulated into having a "fight" which, when considered in cooler moments, wasn't actually a fight for anything it particularly wanted.

How We Are Supposed to Hate Obama for High Gas Prices

MeanMesa has watched -- like most other Americans -- as gasoline prices have gone up, up. up.  Immediately behind the "up,up,up" story come the "reasons" why this is happening.  For MeanMesa visitors who have been out enjoying the spring weather (except those having the latest mortal dose of climate change...), we can review some of these "great" "reasons" which both make perfect sense and which absolutely explain not only the rising gasoline prices, but also the "wonderful" "failure to lead" problem the President has because he is from Kenya.

Some of the Really "Good" Reasons
for High Gasoline Prices

Libya

Although Libya produces less than 2% of the world's supply of petroleum, and, although Libyan production has not stopped but cut by half -- making that 1% of the world's supply, US market prices for gasoline have grown around 15% in the last two months.

A World Shortage of Petroleum

When the Libyan affair first began, the Saudis, employing their heavily US subsidized 5% world supply "buffer" increased production to meet the "shortage."  Then, they quit.  Why? Because there was a petroleum glut around the world which had full oil tankers languishing in harbors everywhere, waiting to unload.  Existing petroleum storage is full to the gunwales.

Unrest in the Middle East

Aside from Libya, Middle East unrest seems to be centralized in places which have no oil -- Yemen, Bahrain, Jordan and Syria, mostly.  The countries which actually do have oil are having unrest, too, but they are shooting the protesters in the streets -- thus, no production problems.

Increased World Demand for Gasoline

Most of the "gasoline buyers" in the US and Europe are either broke or terrified of becoming broke.  Prices are high (see title of this posting...)  and gasoline consumption has been curtailed even further.  This is one reason that there are oil tankers parked in harbors waiting for room to open up in refineries so they can unload.

The Other Reason Which Has Absolutely
Nothing to Do with the Price Increases

Oil Industry Corporate Greed

Now, who exactly can expect giant oil companies to simply "absorb" higher and higher per barrel oil prices and leave gasoline at some reasonable rate?  These behemoths are literally "orphaned waifs" of the capitalist system, trapped by higher crude prices on one side and torn by the "social terror" of higher gasoline prices on the other.

As if they cared.  The oil industry has to release profit reports next week.  They will be sky high.  For example, Exxon-Mobile's profits increased by around 50% in the last quarter.  You know.  "Orphaned waifs."

Okay.  "Orphaned waifs" may be a little hyperbolic, but "increased crude prices?"

The actual cost of petroleum to these giants is basically stable.  They own everything.  Producing a barrel of crude this week isn't particularly more expensive than it was last week.

However, even though the "cost" of a barrel of crude hasn't really increased, the "price" has.  The oil price on the "global market" (Ever notice that the phrase "global market" must be incorporated in every news broadcast at least eight times in every 30 minutes?) has gone up without any particular cause, although the "reasons" for the increase are "increased demand," Libya, the Middle East and the "global shortage."

Exxon-Mobile and her sisters get to raise prices when the "global market" prices increase even though their actual production costs don't.  This is how their "profits" can go up 50% pretty much any time they like.

Sewing "Gasoline Prices" to Obama's Thigh
with Really "Good" Mathematics

Well, Petroleum's little sister, the Pharmaceutical Industry, has been spending a million dollars a week trying to sew "health care costs" (Remember, petroleum "cost" versus petroleum "price?") to Obama's thigh with mixed results.  In the wake of that faltering attempt to promote the latest "up is down" corporate fable, every right wing nut job who can hold a slide rule is now very, very busy trying to, you know, sew the oil prices to, oh whatever...

NBC News, Sunday April 24, had a great chart -- not the only one -- which "mathematically proved" that Obama was going to lose the 2012 because "gasoline prices were going up."  MeanMesa wasn't able to extract the NBC chart due to, uh, geriatric technical difficulties, but we did find a real doozey elsewhere on the Google.  There are plenty.

The "Real Doozey:" The "Mathematical" Chart "Linking" Obama's Approval Rating to Gasoline Prices

The Rove Chart Proves Obama Goes Down on High Gas Prices - source

Well, this about "closes the deal" on the wavering re-election prospects for the "failure of leadership" President from Kenya, doesn't it?

Oooops.  Wait a minute.  What exactly does this chart -- and all the thousands of others exactly like it -- prove about anything?

The, uh, "curves" certainly seem to match up in a "convicting way," don't they?  Not exactly.  In fact, not even "generously."  Mathematically, this baby is no more than a "screaming stink hole" one would expect from a numerical analysis student with a hang over facing a pop quiz.

The "curves" might look suspiciously similar, but the real problem is with the indices along the left and right sides of the graph.  The vertical "index" on the left for Obama's approval rating extends from 70% to 30%.  The "curve" of Obama's approval is contained between a high of roughly 70% at his Inauguration and a current reading of roughly 47%.

The gasoline price "curve" has its own, separate vertical "index" on the right which runs, upside down, from a high of $4 at the bottom to a low of $1 at the top.

Between Friday, April 22, and Sunday, April 24, this "graph," accompanied in every instance by the "explanation" that Obama's popularity was "descending" in "lockstep" with the increase in gasoline prices, appeared on every news cast on every network channel - FOX, ABC, NBC and PBS.

So, what exactly is the problem MeanMesa is seeing in this "graph?"

Even Though the Chart Means Nothing,
It's the Thought That Counts

Let's take a look "by the numbers," hopefully in a way which won't send MeanMesa visitors screaming off to find their old high school algebra text somewhere in the attic.

1.  The "scale" of the index columns on the left and the right of the chart have nothing to do with each other.

The data in the chart would have been just as "accurate" if the index columns on the left and the right had been prepared within rational limits instead of the artificial ones necessary to make the curves coincide. Further, by changing the height of each increment, shown as a difference of 5% in the approval rating and a difference of $.50 in the gasoline prices, the corresponding curves would  no longer have appeared to have some sort of functional correlation.

Obama's approval rating is spread across the entire gambit between 70% and 30% although the lowest it went in the period was above 45%.  The index scale had to be expanded to "include" an additional, unused 15% "buffer" at the bottom so the approval curve would "sit" on the gasoline price curve.

Likewise, the gasoline price curve also had to be indexed artificially with a range from $1/gallon to $4/gallon in $.50 increments, even though the actual curve would have required only the range between $1.75/gallon and $3.25/gallon.

By using the synthetic "scale" adjustments of the indices of the two curves, the chart was able to show -- or at least, imply -- a non-existent functional correlation between the two which doesn't actually exist.

2.  Obama's approval rating has both decreased and increased during the time of the greatest increases in the gasoline prices.  It is currently higher than it was when the gasoline price changes began.

Contrary to the accompanying narrative given on the news broadcasts, during the most precipitous increase in gasoline prices from $2.60 in September of 2010 to $3.45 in February of 2012, Obama's approval rating has increased from 43% around September of 2010 to 47% by February of 2012, with a high point of 49% in January 0f 2012.

After both the rebuttal of the Ryan economic plan and the announcement of an investigation into possible raw speculation on the gasoline prices, by now, Obama's approval rating has increased even higher.

However, the "narrative" offered as an interpretation of this chart always included the corporate media "instructions" to viewers that they were "supposed to believe" that Obama's political fortune was "collapsing" with the rising prices.

Now, MeanMesa visitors know better than to "take the bait."

As to the "Thought That Counts," enjoy a few excepts from the Rove article where we got the graph.  The entire article can be read here.

From KarlRove&Co, Polling News and Notes:

Presidential Approval and Gasoline Prices: The Energy Information Administration reports that the fighting in Libya has caused the retail price of a gallon of gasoline to rise to $3.52 this week.

Hmmm.  "The Energy Information Administration?"

Hmmm.  "...fighting in Libya?"

The graph below shows President Obama's weekly approval rating, as calculated by Gallup, compared against weekly average retail gasoline prices, as published by The Energy Information Administration.

Of course, these comments refer to the graph above in this post.  Further, the sentence is, perhaps when considered over generously, basically accurate.  However, the "compared" idea is deceptive.  No actual comparison is made in the graph, that is, no conclusion of a functional connection between the two curves can be taken from the information as it is presented.

Don't let them trick you.

Get ready to do whatever is necessary to win the 2012 election, starting with "not losing heart" after being bathed with cheap shot GOPCon "media math."

MeanMesa's compliments to the President.

Karl Rove Finally Flinches in Fear

The Supreme Court calls for a "review" of the Don Siegalman case.  In this instance, the "wicked witch" is none other than Karl Rove, the corrupt, fascist servant of the late autocrat, the unelected President "Pretender," George W. Bush.

Karl Who?  Ah' don't think Ah' know no Karl!
Heh, heh.  Do Ah' hef' to go to jail now?  Ah' gotta' git back to Dallas...

 Karl Rove
Mr. "Fix-it" to Unelected Autocrat, Bush Jr.
Corrupt Enemy of Democracy and Justice

About Karl Rove from Wiki:
Read the whole Wiki article here

Karl Christian Rove (born December 25, 1950) was Senior Advisor and Deputy Chief of Staff to former President George W. Bush until his resignation on August 31, 2007. He has headed the Office of Political Affairs, the Office of Public Liaison, and the White House Office of Strategic Initiatives. Since leaving the White House, Rove has worked as a political analyst and contributor for Fox News, Newsweek and The Wall Street Journal.

Prior to his White House appointments, Rove was a Republican political consultant and strategist. Rove is credited with the successful 1994 and 1998 Texas gubernatorial victories of George W. Bush, as well as Bush's 2000 and 2004 successful presidential campaigns. Rove has also been credited for the successful campaigns of John Ashcroft (1994 U.S. Senate election), Bill Clements (1986 Texas gubernatorial election), Senator John Cornyn (2002 U.S. Senate election), Governor Rick Perry (1990 Texas Agriculture Commission election), and Phil Gramm (1982 U.S. House and 1984 U.S. Senate elections).

Rove's name has come up in a number of political scandals, including the Valerie Plame affair, the Bush White House e-mail controversy and the related dismissal of U.S. attorneys controversy.

MeanMesa has experienced plenty of, uh, "digestive moments" watching the sordid tactics of Karl Rove as he sheparded Bush Jr. through election fraud in both 2000 and 2004.   (Remember "caging?"  Thousands of voters in Democratic precincts were removed from the election polls.)

Mr. Rove, thanks largely to the grotesque Attorneys General appointed by the autocrat, was able to almost completely corrupt the U.S. Justice Department, firing all Federal Prosecutors who would not cooperate with his nation-wide scheme to "kangaroo lynch" Democratic candidates.  (Justice prosecuted three times as many Democrats as Republicans during this time.)

However, the MeanMesa's greatest "gastric disturbance" arose from this little crook's amazing arrogance.  Even after an American Democratic government regained power in 2008, not a day passed when Mr. Rove's skanky little mouth didn't need a good washing with some strong soap.

It seemed that all the crimes of looting and protection executed by the neo-cons would simply fade into an unpleasant chapter in a forgotten history.  Happily, maybe not quite so fast!

For the information challenged among MeanMesa's visitors, the tale of just what happened to Alabama Governor Don Siegalman might need a bit of refreshing.  Among all the myriad outrages to the Republic perpetrated by the Bush Crime Family, Siegalman's torment wasn't really that much worse than the norm.  However, this Supreme Court decision may become a landmark of the resurrection of the Nation -- it can evolve to include some of the most powerful and sinister players, right up to the Oval Office.

We can dream.

Siegalman "won" the gubernatorial election in Alabama in 2002.  The man currently sitting in the Alabama Governor's office is not the elected Governor.  Don Siegalman went to bed after that election with a certified victory.  At 3AM the next morning, a smelly bunch of crackers in some remote district "found" thousands of votes which "unelected" Siegalman and "elected" the Republican who had "lost" the "election" the day before.

Sound familiar?  The Connecticut "Cowboy" took control of our country in roughly the same fashion in 2000.

Too many quotation marks for even MeanMesa!

MeanMesa defers to some professional journalism at this point.

An account (TIME/CNN) of just what has transpired with the Supreme Court decision:
In the rough and tumble of Alabama politics, the scramble for power is often a blood sport. At the moment, the state's former Democratic governor, Don Siegelman, stands convicted of bribery and conspiracy charges and faces a sentence of up to 30 years in prison. Siegelman has long claimed that his prosecution was driven by politically motivated, Republican-appointed U.S. attorneys.

Now Karl Rove, the President's top political strategist, has been implicated in the controversy. A longtime Republican lawyer in Alabama swears she heard a top G.O.P. operative in the state say that Rove "had spoken with the Department of Justice" about "pursuing" Siegelman, with help from two of Alabama's U.S. attorneys.

The allegation was made by Dana Jill Simpson, a lifelong Republican and lawyer who practices in Alabama. She made the charges in a May 21 affidavit, obtained by TIME, in which she describes a conference call on November 18, 2002, which involved a group of senior aides to Bob Riley, who had just narrowly defeated Siegelman in a bitterly contested election for governor. Though Republican Riley, a former Congressman, initially found himself behind by several thousand votes, he had pulled ahead at the last minute when disputed ballots were tallied in his favor. After the abrupt vote turnaround, Siegelman sought a recount. The Simpson affidavit says the conference call focused on how the Riley campaign could get Siegelman to withdraw his challenge.

According to Simpson's statement, William Canary, a senior G.O.P. political operative and Riley adviser who was on the conference call, said "not to worry about Don Siegelman" because "'his girls' would take care of" the governor. Canary then made clear that "his girls" was a reference to his wife, Leura Canary, the U.S. attorney for the Middle District of Alabama, and Alice Martin, the U.S. attorney for the Northern District of Alabama.

Canary reassured others on the conference call — who also included Riley's son, Rob, and Terry Butts, another Riley lawyer and former justice of the Alabama supreme court — that he had the help of a powerful pal in Washington. Canary said "not to worry — that he had already gotten it worked out with Karl and Karl had spoken with the Department of Justice and the Department of Justice was already pursuing Don Siegelman," the Simpson affidavit says. Both U.S. attorney offices subsequently indicted Siegelman on a variety of charges, although Leura Canary recused herself from dealing with the case in May 2002. A federal judge dismissed the Northern District case before it could be tried, but Siegelman was convicted in the Middle District on bribery and conspiracy charges last June.

William Canary called the allegations "outrageous" and "the desperate act of a desperate politician." Terry Butts said, "I do not recall this telephone conversation — this whole story must have been created by a drunk fiction writer." A White House spokesman told TIME that since the case of former Governor Siegelman remained before the courts, it would have no comment.

Rob Riley said, "I do not recall making the statement attributed to me." He added: "Neither I nor anyone on our campaign staff have been involved...in a conspiracy to bring a criminal case against Don Siegelman." Louis Franklin, who prosecuted Siegelman, said he did confer on several occasions with Justice Dept. officials in Washington, but that "nobody ordered me to bring this case, and we handled it just like any other."

Canary was appointed by President George H. W. Bush to serve in the White House as special assistant for intergovernmental affairs, and then named chief of staff of the Republican National Committee. Later in the 1990's he also worked closely with Karl Rove in a successful series of campaigns to get Republicans elected to Alabama's state courts.

In an interview with TIME, Simpson confirmed that the "Karl" cited in her sworn statement was Karl Rove. "There's absolutely no question it was Karl Rove, no doubt whatsoever," she said. She also said she has phone records to back up the date and duration of her phone calls.

Though Simpson's legal work primarily involved research for companies seeking federal government contracts, she says she also did "opposition research" on Siegelman as a volunteer in Riley's campaign in 2002. A lifelong G.O.P. supporter, she says she has long been friendly with Riley's son, Rob Riley, whom she met at the University of Alabama and worked with on various legal cases.

In her interview with TIME, Simpson said the participants in the conference call expressed growing concern that Gov. Siegelman would refuse to give up his challenge to the vote count. According to Simpson, Rob Riley said, "Siegelman's just like a cockroach, he'll never die, what are we going to do?" At that point Canary offered reassurance by citing Rove's news from Justice Department.

Simpson said she had long been troubled by the conference call conversation, and even consulted an official of the Alabama State Bar Association to determine whether she could disclose it publicly without violating her obligations as a volunteer working for the Riley campaign. She was told, she said, that she was free to speak of the matter.

Simpson said she grew more concerned about the matter after Siegelman's conviction last June. She says she told several friends about the conference call ; one of them, Mark Bollinger, a former aide to a Democratic attorney general in Alabama and in the Alabama Bureau of Investigation, has given his own affidavit, obtained by TIME, swearing that Simpson had told him of the conference call and Rove's alleged statements.

The federal investigation of Siegelman culminated in a criminal prosecution that became public not long after Siegelman announced that he would run again for governor of Alabama in 2006. Partly because of the investigation, Siegelman failed in his bid for the Democratic nomination.

Siegelman, together with former HealthSouth CEO Richard Scrushy, was convicted on bribery and conspiracy charges and faces sentencing June 26. Lawyers for Siegelman and Scrushy told TIME they were considering whether to use Simpson's affadavit in expected motions to dismiss charges against their clients, or in some other phase of what is likely to be a protracted appeals process.

Siegelman was convicted of appointing Scrushy to a hospital regulatory board in exchange for a $500,000 contribution to a campaign for a state lottery to fund education. Defense lawyers have argued that Siegelman drew no personal financial benefit from Scrushy's donation to the lottery campaign, and they note that Scrushy had served on the hospital regulatory board under three previous governors, before Siegelman reappointed him. The reappointment, they have argued, offered little of value to Scrushy except more work.
